Dear Sir's

I have owned a small business.

With an mutual understanding my friend had made investments (Working capital) and i'll complete the works by myself and the profit will be shared by us equally.

I've have registered with SSI under my name as a sole proprietor ship and opened a bank a/c with my name as sole proprietor.

This is Small business that does not cross Rs. 10 lakhs in total hence i didn't registered with VAT or ST.

As my friend was investing we produced his PAN for our clients for TDS purpose.

In this situation my friend has another business to watch around will not be able to provide any investments. All his previous investments were returned to him and settled.

All my question is How to Change the PAN details which was available with my clients? Is their any procedure? else shall i write a letter to my clients asking them to amend the PAN details available with them?

Request your reply at the earliest.

Thanks in advance...

My mother wants to give her bank fixed deposits amounts invested to her daughter-in-law [ that's my wife ] after my mother's death, through a WILL & no body has any objection towards that.

If my wife receives such amount in future & she invests such money in fixed deposits in her name, will that income be clubbed under my income head or will it be my wife's seperate income? She is a housewife.

Please reply at earliest. Thank you very much.
Regards.

Tax benifit under section 54

Dear Sir / Madam,

My question is related to long term capital gain arise on sale of house property.

Mr. A sold his self occupied property and LTCG is Rs. 11,00,000/-

Mr. A is having another Property (35%share)with his daughter (65%share)

my question is can Mr. A invest his Rs. 11,00,000/- LTCG in same house property to increase his share 35% to 50% in said property and avail the tax benefit u/s 54.

i referred the following article :

"Purchase of portion of self-occupied house is also eligible for exemption- Section 54
nowhere states that a residential house which is purchased by the assessee so as to avail the
exemption should not be the one in which the assessee was residing. One cannot argue that
assessee is not entitled to exemption under section 54 merely because the assessee was residing
in the house which was purchased by him. Thus, where the assessee sold a house property owned
by her and out of the sale proceeds purchased 15 per cent share in another house property owned
by her husband and son, exemption was allowable even though the assessee was residing in the
said house prior to purchase, and continued to reside in the same house after purchase
- CIT v. Chandanben Maganlal [2002] 120 Taxman 38 (Guj.)."
