question on employer-employee relationship in FBT

Hello Sir,

In CIRCULAR NO. 8/2005, DATED 29-8-2005 issued by CBDT as Explanatory Notes on the Provisions relating to Fringe Benefit Tax There are few FAQs. One question is

Whether employer-employee relationship is a pre-requisite for the levy of FBT?

The answer is 'Yes'.

My question here is whether a Managing Director of a private limited Company who is owning 60% of the shareholding is considered as an employee of that company for the purposes of FBT.

In course of articleship is there any limit in no of transfers? If any how many are available in the old course?

One of my friends has got an offer for Accounts Manager in a company named Access Financial Services Sarl (Swiss company). The package offered is good but he doesnt know about the credentials of the company. It has come to know that the company is management solutions provider in few countries and its presence in India is not so long. If you can, please tell about this company and help me out.

adjustment of short term capital loss

Sir,

If someone is not filed his return on time, can he claim the short term capital loss and carry forward the same ? Please clarify with reason.
