One of my client is buying an images from Shutterstock Inc.for its Online Business Activities. Here one of the Director is making payment to Shutterstock thru his Cr.Card and subsequently Company reimburse it to him in INR.

Here my query is whether Withholding Tax will be applicable to such type of Transaction and if yes then what will be the Rate of TDS.

Is Grossing Up of Tax reqd.(say if they are paying Shutterstock USD 100 then will have to consider it Net of TDS and pay TDS by Grossing Up the payment)

During the course of departmental audit it was observed that the service provider didnot claim SSI exemption for the first three quarters , but he claimed the same in the last quarter.....but deptt has raised objections and demanding differential tax ......
