Whether Packing Material supplied by buyer to be included for valuation of basic value for excise duty purpose or not.

Packing material is used for packing of finished good mfg by seller.

Please suggest with rule & case etc regarding it.

MRP Labels

Dear Sir,

I want to know that, is it permissible to affix the individual stickers (Labels)on the package for the making declaration required under the rule 6 of The Standards of Weight and Measures (PC) Rules, 1977

As per my understanding the individual stickers are allowed for the declaration of the revised lower MRP only, and not for the declaration of the MRP.

LETTER OF UNDERTAKING

WE ARE REGISTERED UNDER CENTRAL EXCISE AND WE NEED TO SUPPLY OUR EQUIPMENT TO CUSTOMER LOCATED IN A SEZ. SINCE THE SUPPLIES TO SEZ ARE EXEMPTED FROM EXCISE DUTY WE NEED TO EXECUTE A LETTER OF UNDERTAKING.

PLEASE LET ME KNOW THE FOLLOWING DETAILS:
1. VALUE OF STAMP PAPER ON WHICH THE LUT IS TOBE EXECUTED.
2. THE PAPERS THAT NEED TO BE ENCLOSED ALONG WITH LUT.

Excise rate and turnover

Hello
We are a company based in Pune, Maharashtra

We buy softwares from foreign country and resale it in India.

I like to know on how much turnover it Excise duty applicable and how much is the rate of excise duty

I also like to know, If we design our own software and sell it, what will be the rate of excise and at what amount of turnover.

clarification


We started a company in Chennai,

We import Electrical bike parts under CKD Condition and assemble at our unit.

In process of import we are paying following duties
Basic duty – 10%, cess 2% -, Hig-Cess, 1% and 4% Additional duty.

We would like to know how claim CENVAT in this case

And what is rate of tax for Eelecrical bike as per central excise act.

Please help me

Does the first/second stage dealer require to quote excise duty in the invoice including his profit? or is it sufficient to quote the duty as he paid to the manufacturer/fist stage dealer

Cenvat credit

we are mfrs in a.p. and we have started new project we are purchasing steel , cement etc.,for construction of new factory and incurring other expenses related to this.how to treat these expenses and we re eligible to claim cenvat credit & vat as input?

RG registers

1) Is it true that the RG registers have been withdrawn??
2) If it still exists, then what are the consequences of non-compliance ie for not maintaining the registers??

We manufacturing Tractors for agriculture purpose as well as supplying the Tractor Parts to our customers from our Spare Parts Division situated in the same premises on one registration no. in Central Excise Department from 1st June-06 under cover the notification No. 14/2008-C.E.(N.T.), dated 1.03.08. Tractor is exempted for the payment of Excise duty and the “Parts, components and assemblies of any automobiles “are liable to pay the duty.

For the fulfillment the purpose of supplying the ‘Spare Parts of Tractor’ to the customers, we procure the material from the supplier’s in our “Spare Parts Division”.

After doing the re-packing and labeling of our company’s brand name, we sell the parts to the dealers and stockiest and discharging the duty of MRP after claiming the abatement.

In addition of the above, we procure the pre-packed material from the “ABC” in the fix lot size packing with the declaration of “ Manufactured and Packed by ABC “ which is required by the rule 6 (1)a of The Standards of Weight and Measures (PC) Rules,1977. from the suppliers who is situated in the duty exempted area in the Parwanoo of Himanchal Pradesh. ( being in the exempted area the said supplier not charge the duty, so there is no question of the duty credit at our side) and further when we sale these parts so purchased we not do re-packing and labeling (means we sale this material as it is condition) treating it as non-excisable sales.

My query is :- Can we sale this material without charging the excise duty as we are not doing any packing or re-packing, labeling on the above said material.
Pls. Clarify.

can any body what is ER1 & ER3
i have filed Refund of terminal excise duty at DGFT, after filing the application i got query regarding submission of ER1 & ER3.

can anyone help me.
