If the articleship is terminated within a year and the new articleship is taken after 5 months and the termination form is also sent after 5 months, will there be any problem for the student?

No. You only need to pay charges for delay in submission of form.

There is no time limit if some one struggling to find a new CA. The time limit is imposed if someone after joining with the CA failed to submit his/her form within prescribed time.
From the query it appears that questioner is able to join with another one only after 5 months.
Therefore, no fees is required to paid only your articleship period will be extended.
