Appointment of wtd - filing of form

Kindly let me know whether Form MGT 14 needs to be filed in case of appointment of WTD in private company? If so, let me know the refered section.

25 February 2015 Yes.

Pursuant to rule 8(5) read with section 179(3)(k), resolution relating to appointment or removal of KMP would required to be filed with ROC within 30 days through form MGT.14.

If he is not appointed as KMP, as the section is not mandatory for private limited company, then is it required to file MGT 14?

You have to file MGT 14 & DIR-12.

Only exemption is filing of MR-1
