Appointment of whole time CS

29 January 2010 Respected Sir / Madam,

Please provide your expert views on few doubts that I have regarding the appointment of whole time CS in a company u/s. 383A:

1-Should he/she be appointed as an employee-whether full time or part time, or the appointment can be on retainership / consultancy basis?

2-Should separate CS be appointed for every company of the same group or can a single person be appointed for all the companies belonging to a group?

30 January 2010 If company has paid up capital of 10 lacs or above but less than 5 crore than you can appoint retainershihp which can be one PCS for all company having paid up capital as per above limit.

But if the paid up capital is 5 Crore & above than you have to appoint CS as an employee. As one person can be CS for one Company at a time. So in ur group if there are more companies having 5 crore or more capital than seperate CS have to be appointed for each such company.
