As per provisions section 203 of the Companies Act, 2013 specified companies required to appoint a whole time Company Secretary. Whether it is necessary to appoint such company secretary in whole time employment and payment should be made in the form of salary or he can be appointed in the professional capacity and paid professional fees towards his services rendered in that company.
In other words whether it is necessary to establish employer employee relationship between the company and whole time company secretary, to comply with the provisions of section 203 of the Companies Act, 2013.
