30 August 2020 I think after the death of the karta, sons automatically acquires the status of karta in HUF

14 July 2024 When applying for a duplicate PAN card for an HUF (Hindu Undivided Family) where the karta (head of the family) has passed away, and there are three members (wife and two sons), here’s what you need to consider:

### Signing the Application Form:

1. **Who can sign the form:**
- In the case of an HUF, after the karta's death, the next senior-most adult member of the HUF can sign the application for a duplicate PAN card.
- Typically, this would be the widow (wife of the deceased karta) or one of the adult sons, depending on the family arrangement and consent among the members.

### Documentation Required:

1. **Proof of Identity (PoI) and Proof of Address (PoA):**
- The following documents are generally required to apply for a duplicate PAN card:
- Proof of Identity (PoI): Aadhaar card, Voter ID, Passport, Driving License, etc.
- Proof of Address (PoA): Aadhaar card, Voter ID, Passport, Driving License, utility bills, etc.
- Since it’s for an HUF, documents that establish the existence of the HUF and the relationship of the members (like family deed, birth certificates, etc.) may also be required.

2. **Proof of PAN:**
- Any previous PAN card details or acknowledgement number of the lost PAN card, if available.

3. **Additional Documents:**
- Death certificate of the deceased karta.
- Affidavit stating the details of the lost PAN card and the circumstances.

### Steps to Follow:

1. **Application Form:**
- Obtain Form 49A for PAN card application (for Indian citizens) or Form 49AA (for foreign citizens/entities).
- Fill out the form correctly, ensuring all details are accurate.

2. **Signature:**
- The designated member (widow or one of the sons) should sign the application form.

3. **Submission:**
- Submit the filled application form along with the supporting documents (identity proof, address proof, etc.) to the nearest NSDL or UTIITSL PAN center.

4. **Processing:**
- The PAN application will be processed by the authorities, and upon verification, a duplicate PAN card will be issued.

### Conclusion:

Ensure all documents are in order and accurately filled out before submission to avoid delays. It’s advisable to consult with a tax advisor or visit the official NSDL or UTIITSL website for any updated requirements or procedures specific to applying for a duplicate PAN card for an HUF.

Best regards,
