ACIT HAS SERVED DEMAND OF RS AROUND 10 LAC
DUE TO DISALLOANCE IN EXP AND SOME CREDITORS HAS NOT CONFIRMED.
I HAVE FOLLOWING QURRY
1. AFTER RECEIVING DEMAND WHAT IS PROCESSOR TO FILE APPEAL
2. AND HOW MUCH TIME APPEALATE AUTHORITY WILL TAKE TO HEAR CASE.
3. WHAT IS DEPARTMENT RECOVERY PROCESSOR
4. WHAT IS PROCESSOR TO FILE STAY
PLEASE THIS IS URGENT ,

16 December 2009 1. First appeal lies with ACIT (Appeals).

Form 35 in duplicate is to be filed togetherwith a challan of Rs.1,000/- within 30 days of receipt of the assessment order.

Copy of Assessment Order, Original Demand Notice are to be enclosed.

In Form 35 you have to say "Statement of Facts" and "Grounds of Appeal".

2. Now-a-days; appeals are heard within a year.

3. Since tax demands are high; hence department will make pressure to pay the tax although appeal is pending.

4. You should request the ACIT (Appeals) to stay the demand at the time of making the appeal. Looking to the genuine hardship; he may grant a stay.

It is advisable to hire the services of an expert to avoid hardship.

THANK U SO MUCH FOR REPLYING QUICK,
BUT SIR I WOULD LIKE TO KNOW IF THE ASSESSEE WILL NOT PAY TAX ON GROUND THAT THE MATTER IS IN APPEAL,
WHAT THE DEPARTMENT WILL DO HOW THE DEPARTMENT WILL MAKE PRESSURE I MEAN WHAT IS METHOD OF RECOVERING TAX.

16 December 2009 Due to "blessings" of Mr. Chidambaram, the then Finance Minister; and the provisions amended in the Income Tax Act; now the department will immediately ask to pay the demand; even if matter is under appeal.

Department can seize your bank accounts if you do not pay the amount.

17 December 2009 sir,

thank u so much for again replying sir if you dont mind can u please tell is there any processor to deposite little bit amount like 1 or 1.5 lac to get stay order. because the assessee is not in position of pay whole amount . and the totaly demand is created by ACIT wroungly by disallowing 80% amount due to notice related to confirmation is not received by credited.
