30 April 2013 Rent of a building - Rs.4,50,000/- is splitted and paid to different payees instead of paying to a single payee(in order to prevent TDS).The aggregate amount paid to different payees in the previous year is not exceeding Rs.1,80,000/- but the rent per month is greater than Rs.1,80,000 i.e.,Rs.4,50,000....are they correct in doing so ? Is it a tax evasion or tax planning?

30 April 2013 The threshold limit is available for payee wise.

Verify rental agreement, if all payees are covered as co owners and company paying less Rs.180000 then no TDS.

If the company intentionally splits the amount in order to avoid TDS then it is clearly tax evasion.

Further note that the limit of Rs.180000 is for year.
