how many month's notice period is required to be given

This query is : Resolved

16 January 2018 Respected experts:
kindly guide me how many months notice i have to give i joined the organization in April 2015 & still working.
Terms & conditions of appointment are as follows:

Initially you will be on probation basis which be extended further to another one year by the appointing authority. Your services may be terminated during the probation or extended probation period by giving one month’s notice or salary in lieu of the notice.

After successful completion of probation or extended probation period you will be communicated in writing about your confirmation. In absence of such a communication your term automatically comes to an end & you will cease to be an employee of the institution.

After confirmation your services may be terminated by giving three month’s notice or salary in lieu of the notice.

And institute did not communicate any confirmation notice about my services & no intimation to be ceased the employment yet.

So how many months notice is required to be given ?

Kindly guide me in this regard.
Thank You in advance

16 January 2018 Your service is more than 2 yrs of probation period so. Your Service is confirmed so you have to give 3 months prior notice as per terms of appointment.

28 January 2018 Thanks for your reply sir, but one person joined with me also resigned after completing 2 years 4 months service and gave one month's salary in lieu of one month notice.
And another person who also joined with me the institute asked in office (as he got Govt job) ,office people told your services not yet confirmed as no confirmation order was issues yet so one month notice will be applicable.
On the basis of these cases i think that i have to give also one month's notice or salary in lieu of.

28 January 2018 If your company is not strict to 3 month notice its good, but as stated in your question terms of appointment notice period after confirmation it is 3 months notice or lieu of salary, if no confirmation after 2 years of service service continued its deemed to be Appointment is confirm.
Since you have completed more than 2 yrs and they have not terminated your service it deemed to be appointment is confirmed as per appointment order.
If your colleagues they have insisted one month notice or one month in lieu of salary than its OK, but if they try to terminate you than you can claim 3 Months notice or 3 months Salary if notice not served.

29 January 2018 Ok thanks sir for your expert guidance.
