Which itr file for income tax return (freelancer)


17 July 2017 Dear Sir,

Please take a note that, i am freelancer and earning of Rs. 15,000/- monthly.
Please guide which ITR file for income Tax return.
i have only one income source

18 July 2017 Itr-3 or ITR-4, in both you can file as no-accounts case without any problem.

Thanks for your quick reply.
We have filed the Return for the FY 2015-2016 and use the ITR 4 but they consided as a defective in u/s 139(9).
then again we have filed u/s 139(9) and mentioned the reason i am not maintning the Balance sheet and Profit & Loss A/c.
now we have received reply from Income Tax "NON-ACCEPTANCE OF RESPONSE TO DEFECTIVE RETURN NOTICE COMMUNICATION".
Also note that, we have received the following description from Income Tax Side
"As you offered income under head of income 'Business or Profession' and as your business income is more than 1,20,000 as per Section 44AA, maintenence of
books of accounts is mandatory. Hence filling of Part A of the P and L A/c and Part A of the Balance Sheet is mandatory.
Even if you have not maintained books of accounts, as per explanation (f) under section 139(9) read with section 44AA filling up of Part B of both P&L A/c and Balance sheet is mandatory. Hence reply is not acceptable."

Please guide in this case what to do?
