Wct on inter state works contract

04 January 2014 Hello Experts,

One of my client is registered under WCT in state of Maharashtra. He had taken contract work in state of Gujrat.

Which rate he should apply , cst @ 2% or Wct @ 8% ?

Is their any requirement to register under Gujrat VAT Act?

Can he raise bill on office situated in Maharashtra for work done in Gujrat & accordingly charge 8% wct?

04 January 2014 A Maharashtra dealer can take up WCT in Gujarat.If he purchases all or even some material required for the contract in Gujarat,he has to take up a registration under Gujarat VAT Act and file return and pay tax like a Gujarat dealer. If he takes all the goods necessary for the contract from Maharashtra itself and only employs labour there,or even takes labour also from his place,then it becomes an interstate WCT.If the contractee gives a C form-which is not possible-2% CST otherwise 8% CST.....mjk
