Voucher payment in cash above rs.20,000/-

28 June 2012 Our factory construction is going in 12 acres of land on and to level the ground we have to use JCB which will take more than one month to level the ground.

I have to make rental payment of JCB in cash which will be roughly works out to Rs.7 to 8 Lakhs. The JCB owner has PAN and given me the bill for the above said amount and which we are going to deduct TDS before making the above said payment.

Kindly let me know if i will pay the bill by cash will it attract Sec.269SS.

If so what is remedy avaialble to me.

Kindly clarify immediately since the issue is very urgent.

28 June 2012 Section 269SS is not attracted since it is not repayment of loan or advance.

Since this expenditure is a capital expenditure and NOT revenue expenditure, Section 40A(3) is also NOT attracted.


28 June 2012 yes i am agree with siddhartha. u/s 40a(3) is not applicable on capital expenditure.
