This query is : Resolved

12 February 2013 A hospital wants to enter into an agreement with a doctor.
The doctor shall use the hospital’s premises and share the earnings with hospital.
What kind of agreement should they enter into?
There is no contribution. Only the doctor is depositing some money with hospital as security deposit.
Please guide.
Thanks in advance.

12 February 2013 Rohini,

the agreemennt should be in the form of a Memorandum of Understanding wherein you can include the fee sharing clause.

12 February 2013 Thanks Ankit.

And there is no requirement of registration of MOU. Right?

What if there is a dispute?

12 February 2013 You are welcome...

No there is no legal requirement of registering the MoU. However, for the sake of authenticity, it may be executed on a stamp paper of Rs. 100 and be attested by a Notary.

you can include a clause for referring the dispute to the arbitrator.

even if the MoU is not registered, it does not loose its validity and therefore, you can go in appeal in case of a dispute.
