Without TAN you can not pay TDS. So question of filing TDS return does not arise. If you have deducted TDS and yet to pay TDS then you will have to deposit TDS along with interest. For 234E you can apply for waiver on the ground of not having TAN alloted.
If there is a delay on your part in applying for TAN penalty may not be waived.
