Tds on salary

This query is : Resolved

03 January 2012 Employee has joined my Company in September 2011. He has submitted Form 16 received by him from his previous employer and have duly filled in Form 12B. The employee was entitled to HRA as a componant of his Salary from his previous employer but he had not claimed for the HRA exemption then even though he was staying on Rent and had Rent Receipts. Now he is submitting to us Rent Receipts for entire 12 months and has asked us to consider the HRA Exemption for the entire year. Can the company consider the Rent paid for the entire year and take into consideration HRA received by him from his previous employer when he has joined us only from September 2011??

03 January 2012 Yes. The present employer can consider HRA for the whole year on the basis of information in Form 16 of the earlier year and rent receipt being furnished by the employee.
