09 November 2012 A foreign company not having permanent establishment in india is providing repair maintenance service in india . what will be the rate of tds if applicable. The company belongs to Norway.

10 November 2012 If Company has PAN then 2% otherwise 20% u/s.194C

22 December 2012 sec.194C is not applicable in present case.

There are some recent rulings which have held that TDS should not be deducted in case of repairs.
