Tds not deposited by deductee nor issue the 16a

20 July 2012 TDS Not Deposited by deducte (A Company ) or not issue form 16A ,Since2010
After ask about 16A there reply is negative ,

i ask for complain , They said you do what you can ?

I contact ITO in there area they are not interested in this matter,My local ITO said its very far from there judrication so the cann;t help

I can send mail letter & on call only ,

Is any right-way to learn lesson for this type of TDS Cheater ?

I advice some local advocate but they said there legal expenses more than my TDS

Already he Deducted abour Rs 73,000.00 in Last 4 year from me . I have invoice of it

20 July 2012 You can give a complient to TDS circle of the deductor with supporting documents.

20 July 2012 Dear Friend,
My question is that, did they deducted the TDS from your bills..,,

If it is so, then you can take further steps, but if they have neither deducted the TDS nor deposited the same, that this is their fault only and you dont have to say anything to them.

Those expenses will be disallowed in their IT Computation, so they will be in trouble.

20 July 2012 Dear Friend, according to the provisions of Income Tax Act, 1961, tax must be deducted as applicable. If some body is not deducting tax then the problem is with him, his expenditure will be disallowed by the AO and it does not affect on your assesement. Plz check the TDS from your 26AS statement for confirmation. Thanks

20 July 2012 first check whether company has deducted TDS or not. Because if they are refusing then there must be a point from there side.
if they have deducted TDS and didn't deposit then you must write to their ITO and if he is also not listening then send CC to higer authority also with all proofs
