Tds deduction

04 October 2012 Hi Dear Experts.

I Have a query regarding that one of my client started a commission earning bussiness in Hospitality and marketing and he kept the 12 employess with paying salry of 12-15 thousand and he appointed one of the the foreigner as a consultant and she getting 50% of share in the bussiness as on monthly basis settlement. so can we r eligible to deduct the TDS on employees salary.
If yes than tell me the detail processor to how should i deduct it and what the processr shall i fallow..

04 October 2012 If you are paying a monthly salary of Rs. 15,000 to every employee, the total income comes to Rs. 1,80,000 for the year.

Since the amount is less than Rs. 2 lakh, TDS is NOT required to be deducted.

04 October 2012 I Agree with u bhardwaj sir but even i m paying some the amount to the consultant. Is her we consider as a employ or not in the bussuness..



04 October 2012 On Consultancy Fees you have to deduct TDS u/s 194J @10% if the Fees is above RS.30000/- and on salary would be governed by 192B
