18 June 2009 is it mandatory to deduct TDS if assesee has TAN number but not in Tax Audit u/s 44AB form last 2 years

18 June 2009 Yes, if you have TAN then the liability to deduct TDS arises even if Tax audit is not mandatory in respective year.

18 June 2009 No Ajay,
There is no liability to deduct TDS if there is no tax audit u/s. 44AB in last year. TAN number is only necessary to pay TDS. It has nothing to do with the liability. Therefore even if you are holding TAN but if you are not liable to deduct tax then tnere is no necessity to deduct the tax.


18 June 2009 holding of TAN does not make it mandatory to deduct tax, tax is to be deducted only when u r liable to do so as per the provisions of the IT Act.
