08 July 2015 My son has obtained a citizenship of USA. He was born in India. Hence I understand he can be treated as NRI/Peron of Indian Origin.

Now my query is as under :
(1) He has been in the F.Y 2014-15 going to us and returning back on 2-3 occasions but the total no of days has not exceeded 180 days.

(2) However in the current financial year he has come to India in May and is expected to remain in a India for more than 1 year. He is also likely to invet in India.

(3) What will be his tax status ie. whether he can file returns in India claiming all the benefits as available to Indian citizen for the F.Y 2015-16 (Asstt.Year 2016-17) since his stay is likely to be more than a year. He may also stay back in India, if he is successful in India.

(4) 180 Days calculation is done on Financial year basis or on 180 days basis extending to two financial year also can be counted?

2. for fy 15-16 he will be resident

4.it is calculated on fy and its 182 days
