Storage racks installed in factory - credit admisible?

Dear Sir,

Factory has installed storage racks in factory warehouse. Racks are used for keeping raw material and finished goods.

Chapter heading is 94, 73.

As per my knowledge the above excise chapters are not falling under capital goods definiation. Therefore credit is not eligible.

Any anyboday give case law or other details related to this.

30 August 2012 not admissible, they are not a part of compulsary machine used for production.

28 February 2013 Dear Sir,

These are not compulsary machines but without these industry cannot operate.
I think this has to takeup with F.M. so that industry will get cenvat credit.
