A public company had started the business 2 years back before obtaining the certificate of commencement of business and also made default in holding statutory meeting. Later on the company filed a petition to CLB and has obtained the Certificate of Commencement of Business. whether the date when certificate issued or date from which company actually started business will be counted for statutory meeting?
In my opinion the date of issue of certificate of commencement of business will be counted for the purpose of holding a Statuory Meeting as this is the date when a Public Company is entitled to commence its business:-)
