Speulative income: other sources or business income

12 July 2013 Intra Day Trading in Shares without delivery is Speculative Income or Loss, however I have only 5 intra day transactions and the number of transaction in shares are not too high. So can this Income from intra day trading be considered as Income from other sources rather than Speculative Business Income under the head Profit and Gains from Business and Profession. Accordingly no need to file ITR 4
