29 April 2011 If v r paying tpt chgs to transporter & the same v have not recovered from customer so who will levy to deposit the service tax...

29 April 2011 I think, you want to ask "who will be responsible to deposit the service tax?"

in your case, as transporter is collecting service tax from you, he is liable to deposit the service tax under his STC codes.

does't matter, whether you are collecting such amount from your customers, or bearing yourself.

29 April 2011 Dear Mr Rathi,

He is not collecting the service tax he just mentioned on his debit note that "sevice tax is payable by consigner/consignee"

In that case v get the services from tpt for our customer & v have not charged tpt chgs to our customer so who will responsible to deposit the service tax...

01 May 2011 ok...in such case, as per Rules, the person who is liable to pay freight, is liable to pay service tax.(in case of GTA Receivers)

in your case, if you are liable to pay the freight, service tax liability is also upon yours.
