yes builder can charge the service tax.

If the buyer pays any amount towards consideration for purchase to the builder before his obtaining completion certificate then it would be treated as deemed service & liable to service tax.
If no amount is received by builder/developer before obtaining completion certificate from the competent authority, the whole transaction is kept outside the purview of service tax.
