SERVICE TAX ON COMMISSION PAID TO A FORIEGN COMPANY

23 February 2011 Dear Sir,
We are an Exporter based in Kerala and exporting garments to South Africa,and Middle east.
We have appointed agents in these countries to procure orders and promote our products.
Against the service he provides us we agreed to pay 5 to 10% commission to the agent.and these agents are registered companies of their rspective countries like Kuwait and U.A.E.
Central excise ofiicials has asked me to pay service tax since 2006.
Would you kindly let us know whether I need to pay service tax on behalf of the Foriegn company.

23 February 2011 Service Tax is payable since 18.4.2006, i.e. all payments made after that date is liable to service tax.
