Service tax for second year onwards

16 November 2013 Dear Sir,

One my know person when started an consultancy got a contract for which he used to fetch more than 15 lac per annum so he got registered on day one and collected and remitted Service tax and filed the returns on time.
When coming to second year he could not keep up the contract so could not earn more than 9 lacs so he stopped collecting Service tax.
For third year onwards also the same repeated.
Is he right?

16 November 2013 No its not right.
Once you get registered with Service Tax Department crossing the exemption limit of 10 lacs, you become liable to comply with all the provisions of service tax regularly irrespective of the revenue generation.Even if no services are being provided during the year, it is mandatory to file nil return.

He has already mentioned that he used to fetch ore than 15 lacs p.a

16 November 2013 S sir in first he filed the ITR for 22 Lakhs he paid on full 22 Lacs Service tax with out default

16 November 2013 then you have to continue deducting service tax in future years also as Shubneet said.
