sir i have a doubt, if we charged service tax to our client and shown in our books of account With out ST, how the IT come to know, this is for my knowledge

for eg,
client
Cost 10.00
ST 1.03
Total 11.03


In our books if we show billing amount directly 11.03

they will track based on your PAN number

or service tax registartion number

02 September 2010 I think u are asking that if one charged service tax in bills although he is not liable to pay service tax and show all amount as gross receipt. if this is the case, it will be an offence liable to be prosecuted.


03 September 2010 If you are charging service tax not accounted in the books you might caught

1. While audit, auditor must qualify in the reports

2. Service tax department having random basis audit by the department for all the service providers

3.Some cases Vendor claim CENVAT based on your ST number, department came to know you are collecting service tax
