Please suggest what will be the treatment of service tax under the annual maintenance contract between Ltd com and a proprietor in that case what will be the service tax Liab for both the parties if the service provider is proprietor.is the ratio of service tax between com. and prop. is 3:1.

If the Service Provider is a Company and if his receipts exceed 10lacs., he will be liable to collect service tax from the Individual., and in the reverse case also ., they shall be liable.,
But in the above case reverse charge mechanism doesnt apply., as the AMC is not covered under reverse charge mechanism
