Have started a new Air conditioner Service centre for air conditioner but my total sales turnover is only below 1 lakhs do i have to pay service tax for this ,
i have register service tax and i have service tax no also
As per Notification Number 33/2012 dated 20.6.2012 there is an exemption to Service Providers providing Taxable Services upto Rs 10 Lakhs in a financial year. In other words if any service provider has turnover of less that Rs 10 lakh then he is not liable to pay service tax.
The above exemption is subject to:
a) Taxable services are not provided under a brand name or trade name of any other person.
b) You have not charged Service Tax in the Invoices raised. If Service Tax is charged in the Invoices raised then you are liable to pay that amount to the government.
Once you have charged Service Tax in an invoice then you will have to deposit the amount. Further as per the same notification once you have started paying service tax then you will have to pay service tax on all services provided during the period irrespective of the fact that your turnover is less than Rs 10 lakhs.
So it is advised that if you can get that invoice cancelled and re-issue a new invoice without tax then you would be eligible to take benefit of Small Service Provider.
But the company were we do services for air conditioner , their they ask us ST , if ST is not charged then they are not paying us payment in fact some time because of this we are not getting payment also so only we charge ST in invoice .

Dear i want to know what is the VAT percentage for Air condition supply , im doing AMC for Air condition but if want to register for vat , i want to know what is the vat percentage weather it is 14.5 % or 5.5 % and even i want to know CST percentage pls help me
i have doing Air conditioner ,Chiller Plant , Heat Pump and Refrigerator service and repair , recently i tried to migrate from Vat to GST but doing the process i completed all process but in goods and service i filled service(Maintaince or repair service and work Contract) but i goods im not able to Search HSN Chapter by Name or Code and HSN Code for Air conditioner ,Chiller Plant , Heat Pump and Refrigerator spares could you please help me in this process.
