Dear sir, Thank your for your reply. I have following doubt 1.If the transporter no registered with service tax (local transport) 2.IF the transporter is registered ,in this invoice tax is included ,in that case we have pay extra service tax 3. If any exemption in the rule for overcome this .

As per Section 65B(26) of the Finance Act, 1994; “Goods Transport Agency means any person who provides service in relation to transport of goods by road and issues consignment note, by whatever name called”. Therefore, issue of Consignment Note (C/N) is integral and mandatory requirement before any road transport can be said to be GTA.
If your transporter is a local transporter and not issuing consignment note you are not liable to pay service tax under RCM.
If the person sending the goods pays the freight and service tax you are not liable.

In continuation with seetharaman ji, if the charges for consignment are upto 750 for single consignee and 1500 for single goods carriage then the services are exempted and not liable to be taxed.
Further if your status is individual, then also no reverse charge is applicable. For further analysis and updations on Indirect taxation you can log in to our website www.indirecttaxprofessionals.com
