there is penalty provisions in iccometax act for declaring wrong income .but i like to know that is there any penalty under income tax act for declaring actual income but throug wrong itr.(i mean another itr form instead of actula itr form prescribed by department.

Penalties have not been prescribed or imposed for using an ITR different from the applicable ITR . However, penalties are there for filing incorrect particulars of his income. . Merely on technical grounds penalties are not initiated. It is the motive that creates the difference. .
