11 May 2015 How to deal with cases where the Sale Value was less than the Stamp duty value. How could it be justifiable to ask the assesse to pay tax for the amount he did not received ( i.e difference of stamp duty value less Sale value ).Are there any Cases dealt with the same.

11 May 2015 Provisions of section 50C are very clear in this regard. Only way is to dispute the value adopted by stamp valuation authority on the confidence that the value adopted was unreasonably high than the market value.

11 May 2015 Disputing the stamp duty value might be the option. But, here the transaction was finished with out raising any objection on SDV, as he was in in the necessity then. Now, reffering to Valuationer would be the option. But, the ITD Valuationer will never give report for lower value than Stamp duty value. In fact, he'll go for higher value than that.
What to do. Please advice.


16 May 2015 nothing to do friend...the law stand as it is. sometimes an innocent bears the burnt of laws devised to check on unscrupulous elements
