06 December 2011 In this case your client can not get refund of TDS amount deducted. This is the tax which is payable by the NRI client and provision for computation of tax on such income has been prescribed U/s 115E.

07 December 2011 Just check , whether STT has been paid on the said transaction. If the answer is yes then there should be no TDS and any TDS deducted shall be granted as refund.
