sec 194- a

This query is : Resolved

23 April 2008 Dear Sir,

Sec- 194 -4 " TDS on interest other than Interet on Security" states that tax to be deducted while paying interest to resident. In such a case any interest (other than interst on security ) payable to NOn- resident is exempt from the ambit of TDS ?

23 April 2008 For NRI you have to check the provisions of sections 115

23 April 2008 I understand interest paid to non-residents will come under section 195 'Payments to Non-residents" where whitholding tax will apply w.r.t relevant DTAA provisions. If I am wrong I can be corrected.

Thanking you,

23 April 2008 I AGREE WITH SRI RAMANA.
SEC 195 CLAUSE i applies for tds on int.paid to non res.
TDS deductible @ the rates specified therein or ADT RATES whichever is lower.
R.V.RAO

24 April 2008 Sec 115 is also relevant
