No need to pay service tax to the provider directly pay to the department because even if you pay to the provider your responsibility doesn't end still you have to pay to the department. So better ask the provider not to charge service tax and you directly pay to the department.

He may apply for the refund but you can not escape from reverse charge you have to pay to the department irrespective of the fact that provider has already paid to the department.
