05 May 2011 I am a salaried person. My employer has deducted TDS on salary and paid to the govt. Somehow i did not file IT return for last two years.I want to file the return. Will penalty be leviable?

05 May 2011 If full tax payable has been deducted by employer ,then no interest is chargeable even if we file belated return. But penalty leviable for late filing of return is at the discretion of IT department. From practical point of view no penalty is leviable on you based on my exposure.

05 May 2011 If you are a salaried employee, meaning thereby an employee employer relation exists, tax would have been deducted under section 192. In your case, return would have been filed as per third proviso to section 139(1). Delay, therefore attracts penalty under section 271F.

05 May 2011 Sir they have kept me as a retainer and they issued me form 16A under sec 194J . and deducted tax @ 10.3%. I want to file return for FY 2008-09 and 09-10. Is it possible widout penalty?
What can i do? or i should not file return for 08-09 and file only for 09-10

05 May 2011 Income tax return for FY 2008-09 can't be filed voluntarily since barred by time. But penalty proceedings can be initiated if non-filing is noticed by department.How ever,return for FY 2009-10 can be filed.

06 May 2011 i WILL HAVE TO FILE ITR 4 RIGHT? ALTHOUGH MY INCOME IS JUST LIKE SALARY BUT SINCE THEY DEDUCTED TAX UNDER SEC 194J, I WILL HAVE TO FILE ITR 4. RIGHT SIR?
