rent on immovable property

This query is : Resolved

23 January 2008 is there any exemption limit on rent of immovable property at which service tax is charged....? for eg if a manufacturing firm is paying rent @ Rs 12500 pm then service tax will be charged or not?

23 January 2008 Your question is on Service Tax on payment of rent. As for as the payer of rent is concerned he will be paying as per the bill raised by the service provider. It is the headache of service provider who is resposible to check whether he is liable to collect service tax on the service provided by him.

26 January 2008 liability of service tax is on owner of the rented property and not for you if owners total rent is in excess of rs 800000. the he is liable to service tax and as per your agreement if taxes are charged seperately then he will collect service tax from you and you
are manufactured goodes and you are liable under excise the you will set off your service tax on rented property to manufactured goods
