15 February 2014 tds deducted in financial year 2009 but we get form 16 in financial year 2010 r wise versa . is it problem for income tax filing r not?

Yes there is a problem, you can claim TDS credit in the year in which form 16 A is issued to you & not on the basis of TDS booked by you.
