Regarding service tax 194 c & 194 i

23 February 2013 In 194 I TDS is deducted on exclusive of service tax. In 194 J professional Fees TDS deducted on amt of inclusive of service Tax
But what reason behind that?

23 February 2013 Section 194J speaks about deduction of tax at source (TDS) on any sum which is paid to the recipient.

But, Section 194I speaks about the deduction of tax at source (TDS) on any income paid as rent.

23 February 2013 Hi,

It is the way law is framed.

What i believe main reason is that Individual assessee having no other income depended mainly on rent income. So deducting TDS on ST would amount to lesser receipt of net outflow.

So to save on this govt have given relaxation for non deducting of TDS on ST on Rent.
