Sir/Madam, I am undergoing B.com and my articleship training simutaneously. I am pursuing B.com as regular student as my college has made some arrangement that i can pursue b.com as a regular student even if do not attend college regularly. As i am pursuingboth my article training and b.com together will this be counted as non compliance of ICAI's guidelines i seek your help in finding out Regards, Pranjal mittal

Yes,,it is counted as non compliance with icai guidelines..because if icai ask you to provide certificate from b.com college for timings it is not possible for you to take certificate..where timings not clash with article timings

PURSUANCE OF OTHER COURSE OF STUDIES With the permission of the Institute a student can pursue one course of study at a time. A student has to submit application in Form No.112 to the appropriate Regional Office of the Institute seeking permission to pursue other course of study within one month of joining the college/ course. The office shall grant permission within one month from the date of receipt of Form No.112. The students currently undergoing graduation or other course under general permission, which was given for the articled assistant to pursue graduation course, is withdrawn; therefore should obtain the permission within six months of issuance of new guidelines. The students shall, however, be permitted to complete the academic session/year currently undergoing and switch over to correspondence courses or institutions where no classes are conducted between 11.00 a.m. and 5.00 p.m. on any working day. The certificate portion in Form No.112 indicating college timings etc. shall be countersigned by the Principal of the college with the seal and stamp of the college and also indicating the telephone number and full address of the college. In the event of breach of these guidelines and not taking permission as required, the articles already undergone shall be derecognised for such period as the Institute may decide. In case an articled assistant is found not undergoing articles in the manner prescribed, he shall be debarred from appearing in the exam up to 3 consecutive exams besides cancellation of such period of articles. The concerned member who allowed him to be such an articled assistant be subject to punitive action besides withdrawing either partly or fully his eligibility to train articled assistant. I do not think this will be considered as a non compliance graduation is allowed along with CA. Please go through the rule below:

The articled / audit trainee cannot pursue any other educational or professional course during the period of articleship training except with the prior permission of the Institute.
Permission may be granted to an articled / audit trainee for pursuing one additional course of study at a time during the period of practical training.
However, the Council has granted general permission to trainees to pursue graduation course concurrently with Chartered Accountancy Course by students who have passed the Foundation Examination, as under :-
(i) That articled/audit assistants having joined the CA Course after passing the Foundation Examination shall generally be permitted to pursue graduation course concurrently with the CA Course without obtaining specific previous permission of the Council under Regulations 65 and 78.
(ii) That an articled/audit assistant pursuing graduation course concurrently with the CA Course shall not be permitted to join any other course until he/she completes his/her graduation course.
(iii) That for pursuing any other course of study (other than graduation course) the previous permission of the Council through filing of form 112 shall have to be obtained by the articled/audit assistants in accordance with Regulations 65 and 78.
Form 112 is required to be submitted within 30 days of joining the course with the recommendation of the principal, failing which you have to go for condonation of delay in non-submission of form.
