10 August 2024 To register for the 1-year training under a Practicing Company Secretary (PCS), you need to follow a specific procedure laid out by the Institute of Company Secretaries of India (ICSI). Here’s a step-by-step guide, including details on the contract execution and documentation:

### **1. Training Registration Procedure**

#### **A. Find a PCS for Training**

1. **Identify a PCS**: Locate a Practicing Company Secretary (PCS) who is willing to offer training. Ensure the PCS is in good standing with ICSI and meets the required qualifications.

#### **B. Documentation Required for Registration**

1. **Training Registration Form**:
- **Form 112**: Fill out the Form 112 (Training Registration Form) available on the ICSI website. This form includes details of the PCS, the trainee, and the nature of training.

2. **Letter of Appointment**:
- Obtain a letter of appointment from the PCS indicating the commencement and completion dates of the training.

3. **Training Agreement**:
- Draft a training agreement between you and the PCS. This should outline the terms of training, including duration, scope, responsibilities, and compensation (if any).

4. **Proof of Qualification**:
- Submit copies of your qualification certificates (e.g., CS Foundation and Executive or Professional pass certificates).

5. **Identity Proof**:
- Provide a copy of your identity proof (e.g., Aadhar card, passport).

6. **Photographs**:
- Recent passport-sized photographs (usually two).

#### **C. Submit Documents to ICSI**

1. **Complete Form 112**: Fill out the form accurately and attach the required documents.

2. **Submit the Form**:
- Submit the completed Form 112 and supporting documents to the regional ICSI office or through the ICSI's online portal if available.

### **2. Executing the Training Contract**

#### **A. Format of the Contract**

1. **Stamp Paper**:
- The training contract should be executed on a non-judicial stamp paper. The amount for stamp duty varies by state, but it is typically nominal. Generally, a ₹100 stamp paper is sufficient, but you should check the local regulations in your state or consult with a legal advisor for the exact amount.

2. **Contents of the Contract**:
- The contract should include:
- Names and addresses of the parties (the trainee and the PCS).
- Duration of training.
- Duties and responsibilities.
- Compensation (if applicable).
- Terms and conditions of the training.

#### **B. Notarization and Franking**

1. **Notarization**:
- Notarization is not mandatory for the training contract but can add an extra layer of authenticity. If required by local regulations or for additional assurance, you may get the document notarized.

2. **Franking**:
- Franking is not required for the training contract. Stamp paper is typically sufficient, but ensure compliance with local stamp duty regulations.

### **3. Post-Registration**

1. **Training Completion Certificate**:
- At the end of the training period, obtain a Training Completion Certificate from the PCS. This certificate is necessary for your final qualification.

2. **Submit Training Completion**:
- After completing the training, submit the training completion certificate and other required documents to ICSI for verification.

3. **Follow-Up**:
- Regularly check the ICSI website or contact the regional office for any updates or additional requirements related to your training.

### **Sample Training Contract Outline**

**Training Agreement**

This agreement is made on [Date] between:

**Trainee**: [Name], [Address]
**Practicing Company Secretary (PCS)**: [Name of PCS], [Address]

**Terms of Agreement**:

1. **Training Duration**:
- The training will commence on [Start Date] and end on [End Date].

2. **Scope of Training**:
- The trainee will undergo training in various aspects of company secretarial practice as per ICSI guidelines.

3. **Duties and Responsibilities**:
- Detailed description of duties and responsibilities of the trainee.

4. **Compensation**:
- Mention if any stipend or compensation is provided.

5. **Terms and Conditions**:
- Terms related to termination, confidentiality, and other relevant conditions.

**Signatures**:

- **Trainee**: [Signature]
- **PCS**: [Signature]

**Witness** (if required):
- [Name and Signature]

By following these steps and guidelines, you should be able to register for your 1-year training under a PCS and ensure that all contractual and regulatory requirements are met.
