Presumptive tax under 44ad and 44ada

This query is : Resolved

01 April 2018 I am a doctor running ultrasound clinic. My turnover is approx 1 crore per annum. Can I file return under 44AD showing income at 8% of turnover. Alternatively can I file return under 44ADA showing income at 50% of turnover. In this case can I claim rent, salary, electricity, raw material etc as expenditure.

Dr Sunil Mehta

02 April 2018 1. 44AD is not applicable since ultrasound clinic run by a doctor is not an 'eligible
business' defined therein, but exercise of medical profession.

3. 44ADA is also not applicable since the professional receipts > the applicable limit viz.,Rs. 50,00,000/-

02 April 2018 I think yes... You can declare u/s 44ad for your business related activities except your service... Your service receipts will be declare under sec 44ADA and All other receipts will be declare under sec 44AD...

02 April 2018 you are earning income in professional capacity as doctor i.e. medical professional. you can not opt for 44ad. And your receipts exceeds 50 Lakhs so you are out of 44ada also

02 April 2018 All hospital receipts not under the head of professional incomes... Doctor's service related income will be x calculated under purview of professional head. Other hospital related incomes will declared under Business head...

03 April 2018 but as we have discussed in various earlier posts, once you are covered under 44AA(1), you are not eligible for 44AD.

03 April 2018 Yes... I agreed to you with sec 44AA(1) by Professional income...

But,
What about the other incomes from the Hospital or Clinic or Other incomes except Doctor's service...?
Why not he will declare u/s 44AD....?

03 April 2018 because once you are covered under 44AA(1), you as an assessee becomes ineligible for 44AD
