need your help for following query:

Need opinion on following if you can get thro your CS/CA query forum.
1.Two pvt ltd companies wants to buy one premises land/bldg in joint name, to start their business in different field of their own name and style i.e. ABC &Co, XYZ &Co. Is it possible to do that if yes then what type of docs to be required to avail the premises and get all approvals from different authorities.

Yes they can start a new business by buying one premises together but before that they have to get themselves registered as a company with the ROC and thereafter they should make land/building registration papers in New company's name. And from thereon if they are going to start a trading business then they will have to get registered under VAT and if they are going to start any services then get themselves registered under service tax.

thanks for your kind reply,
but i want to clarify one thing that as their are two cos. and one premise how can i get that premise register under joint name of both the cos and which docs are required for the same???? and any special kind of document is required to be filed with any govt authority???

one more thing both the cos are already regd with ROC, i mean they are already existing cos. not new... only they need to acquire the same premise for altogather different activities... is it possible nw to have land and building in joint name to two different cos. doing different activities????

14 May 2012 Dear Tanveer,

There can be two solutions to this problem.
1. Either form a new company having the promoters/directors of the old companies and then take premises registered in the new company's name or
2. Register the premises in both the company's name as part owners.
But for doing any business in that premises they should have a written agreement and for that purpose it has to be made sure how do they desire to carry on the operations.
