i hv a doubt which relates to refund of TDS.

The company paid TDS on commission payable to managing director subject to approval of shareholders in the month of March, 2008 ie FY 2007-08. The shareholders did not approve the payment of commission in the AGM held after the close of the year.
Can the company claim the refund of TDS amt paid???

30 April 2009 Since you are informing that the tds is related to march 2008 please collect the additional details as detailes below :

1) Whether TDS return for the quarter 2008 has been filed. What they have done to this payment.

2) Whether TDS certificate has been issued to director or not based on this.

3) Wheter the director has utilised the tds portion.

4) After the AGM whether any revised tds returns have been filed.

5) What entry you have passed in books of account on non acceptance by the shareholders at the agm.

If you provide all these details then we should proceed accordingly to get refund.
