Not yet received stipend

This query is : Resolved

11 October 2015 I have so far completed my 1.10 years of my training and have decided to pursue my remaining period of articleship i.e. from December by opting Industrial Training option.

However,my main concern is that I have not yet received the stipend from my principal from April,2015. Total dues from April '2015 to November,2015 shall be Rs. 20,000.00.

I really can,t afford to lose as there is a high chances that my principal will not pay the stipend out of his own willingness ( did the same with my Seniors). I am incurring huge expenses on conveyance to go to an audit place as well.

Therefore reimbursement of my stipend is my urgent need................Please guide me

12 October 2015 Ask your principal na.. Why he is not paying you stipend... ask him about this

12 October 2015 He is very miser and have very violent reaction. He tries to dominate us through his heavy voice and as per the past records he has never given full stipend to anyone .............

I dont want to lose this sum ....

problem is that I cant write letter to Institute once i get my form signed cozzz in that we give declaration that all dues against principal has been settled.......

13 October 2015 but you have to give your account no and all.. then how ur principal will proof that he had paid you stipend..

Cash stipend is not allowed as per rules...!!

13 October 2015 Yaa that's true
Actually all articles who have left this firm wrote that all dues against principal is settled ......as termination form requires to mention the same and they also had mentioned their account number..despite the fact that they haven't received...............
And institute has never questioned and therefore principal is under no obligation to proof.......

Can i write letter to Institute after getting my form 109 signed

04 August 2024 If you have not received your stipend from your principal and are concerned about not receiving it before leaving for industrial training, here’s how you can address the issue:

### **Steps to Resolve the Stipend Issue:**

1. **Communicate with Your Principal:**
- **Formal Reminder:** Send a formal written reminder to your principal requesting the payment of the outstanding stipend. Clearly state the amount due, the period it covers, and the urgency of the matter.
- **Document Everything:** Keep copies of all correspondence, including emails, letters, and any responses received.

2. **Check with Your Institute:**
- **Institute's Guidelines:** Consult the guidelines provided by your professional institute (e.g., ICAI) regarding stipend payments and dues. There may be specific procedures for addressing unpaid stipends.
- **Contact Details:** Use the contact information provided by the institute for such issues. You might find specific contacts for articleship-related concerns.

3. **Submit Form 109 and Address the Issue Later:**
- **Submit Form 109:** While you need to submit Form 109 for your industrial training, you can still address the stipend issue separately. You must declare that all dues are settled, but this does not preclude you from pursuing unpaid dues.
- **Include a Note:** You can attach a separate letter with your Form 109 stating that you have not received the stipend and that you are pursuing the matter separately. This way, you inform the institute of the issue while fulfilling the form’s requirements.

4. **Follow Up with the Institute:**
- **File a Complaint:** After submitting Form 109, you can file a complaint with the institute. Provide details of the unpaid stipend and any evidence you have. The institute might assist in resolving disputes or take action against the principal if necessary.
- **Grievance Redressal:** Use the grievance redressal mechanism provided by your institute. Explain your situation clearly and provide all necessary documentation.

5. **Legal Recourse:**
- **Consult a Lawyer:** If the amount is substantial and your efforts with the principal and the institute do not yield results, consider seeking legal advice. A lawyer can guide you on whether legal action is feasible and appropriate in your case.

### **Points to Consider:**

- **Timing:** Act promptly to ensure that your complaint and request for payment are processed before you transition to industrial training.
- **Documentation:** Ensure all communications and documents are well-documented, as this will be crucial if the matter escalates.
- **Professional Conduct:** Maintain professionalism in all communications to avoid any adverse impact on your future career prospects.

### **Summary:**

1. **Communicate with your principal** for the pending stipend.
2. **Submit Form 109** with a note explaining the outstanding stipend issue.
3. **File a complaint** with your institute after Form 109 submission.
4. **Seek legal advice** if necessary.

Taking these steps should help you address the stipend issue and ensure that you are compensated for the work done during your articleship.
