Non Resident Indian or Not

24 November 2008 hi,
One my Friend(Assistant Engineer) Who Employed at Mumbai, He is From Calcutta.
Actually In the year 07-08 he was out of india for 182 days for Company purpose.

His Total Earning From Salary is 235000/-
& This Money He Received In Dollars Than he Converted Them into Rupees.What is Tax Treatment in Hand of Friend.

24 November 2008 If a person leaves India during the P.Y. then he will be RESIDENT AND ORDINARY RESIDENT AS PER SEC.6(1),6(6)a if he is in India for atleat 182 DAYS during the P.Y.

As per your question he was out of India for 182 days that means he is in India for 183 days, so he will be treated RESIDENT FOR THE P.Y. 2007-08.

If you wants to know exact solution then please tell the actual days for his residence outside India for 2007-08. Also clarify that if has left India earlier or not.

he never went outside india before this.
& he was out of india for correct 182 days.
I also want to know that if he went out of india for 184 or more than that, than what is tax treatment.
